The Website may provide information and various self-help tools for those suffering from nicotine dependence and their concerned significant others, as well as collaboration and communication forums for these users as well as professional users. If You choose to participate in the collaboration and communication forums, You will be asked to agree to a further set of terms and conditions.

Server Log Information that CAMH Gathers

  • Referring Web pages
  • Time spent on the site

CAMH Web server administrators may produce summary reports from these logs and share that information with Website content managers. Website content managers typically use this information in aggregate to understand what pages are popular, how users are navigating to and within their site, and when their sites are used most frequently. While information in server logs generally cannot be used to identify individuals, You should be aware that such information inadvertently may be captured.

By accepting these Terms & Conditions, You agree to assume liability for Your actions on the Website; You will indemnify CAMH for any and all claims arising from its operation of the Website; You will abide by all policies for the Website, as well as all applicable provincial and federal laws; You will limit CAMH’s liability by agreeing that CAMH will not be responsible for any specific level of service, but, rather will provide service on an “as is, where is” basis; and You acknowledge that CAMH may suspend provision of the Website without prior notice.

Terms of Use for Discussion Board Users

Use of the PREGNETS website (“Website”) and/or mobile application (“Application”) by you (“You”, with references to and “Your” as applicable) is subject to acceptance of the following terms and conditions (“Terms & Conditions”). Please read these carefully, and indicate Your acceptance of them on the registration page by clicking on the box that indicates You have read and agree to the Terms of Use.

We will refer to the Website and Application together as the “CAMH Media”.

Appropriateness of Participation

As a condition of Your participation in the CAMH Media programs and activities, You agree to support CAMH’s goals of civility and privacy. Postings must be appropriate. Postings that demonstrate elements of the following will be deleted by the CAMH moderator, in his or her sole discretion:

  • Harassment
  • Posting of personal information about one or more individuals (including mention of a patient by name or other identifier) that such individual(s) would not reasonably expect to be made available in this forum or in a manner prohibited by law
  • Crude, profane or salacious language
  • Discrimination on any basis, including physical or mental disability, race, creed, colour, sex, country of origin,

Posting of objectionable material may be grounds for revocation of Your access to the CAMH Media.

Views Expressed are Those of Users

The CAMH Media provides various self-help tools for those suffering from nicotine dependence and their concerned significant others, and may provide collaboration and communication forums for these users as well as professional users. The purpose of the forums is to create and sustain an online community dedicated to providing an opportunity for users to exchange ideas, provide information, and facilitate general dialogue and opinions. As such, the content appearing in a PREGNETS Discussion Board does not necessarily reflect the views of CAMH, and CAMH assumes no responsibility nor liability for the materials found in such discussion boards or other collaboration and communication forums, nor for any claims, damages or losses resulting from any use of this service or the materials contained therein.

Abusive Expressions or Inadvertent Disclosure by Others

CAMH is not responsible for the content of any postings by its users within collaboration and communication forums. You specifically acknowledge that CAMH is not liable for the defamatory, negligent, inaccurate, offensive, or illegal conduct of users, links, or third parties and the risk of injury from the foregoing rests entirely with You.

Collaboration and Communication Forums Information that CAMH May Log

Cookies are used so You will not have to repeatedly enter user names and passwords when You go to different parts of the Website.

These license terms are an agreement between CAMH and you. Please read them. They apply to the licensed content, which includes the media on which you received it, if any. The terms also apply to any

5.   APPLICABLE LAW.  Ontario provincial law governs the interpretation of these terms and applies to claims for breach of it, regardless of conflict of laws principles.

6.   DISCLAIMER OF WARRANTY.  The servers and licensed content are supplied "as-is."  You bear the risk of using same.  CAMH gives no express warranties, guarantees or conditions.  To the extent permitted under law, CAMH excludes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 7.   LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES.  You can recover from CAMH and its staff only direct damages up to Cdn. $5.00.  You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.

This limitation applies to

  • Anything related to the licensed content, software, services, content (including code) on third party Internet sites, or third party programs; and 
  • Claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law

It also applies even if CAMH knew or should have known about the possibility of the damages. 

8.   ARTICLES.  Articles that appear on our website are for information purposes only. The nature of this information in all of our articles is intended to provide accurate and authoritative information regarding the subject matter covered. 9.   POSTINGS - TERMS OF SERVICE.  Please Be Warned: The postings on our discussion boards are posted directly by the members. We cannot monitor all of the postings on a 24-hour basis. We do our best to monitor postings and we do remove postings for which we observe or have received verifiable complaints. However, the viewer/visitor to this section is asked to use due diligence in responding to any posting. Our website is open to everyone on a 24-hour per day, 7-day per week basis. Postings may come in faster than they can be monitored. Use appropriate caution.

If you choose to enter the discussion board and view the posting section, you enter it and use this section at your own risk. If these conditions are understood and acceptable you are welcome to enter the discussion board and view the posting section.

10.   APPROPRIATENESS.  Participation on this website relies on civility and privacy.

Postings must be appropriate. If any posting demonstrates the following, it will be deleted by the moderator:

  • Harassment
  • Mention of a patient by name or other identifier
  • Crude or salacious language 
  • Discrimination on any basis, including race, creed, colour, sex, country of origin, etc.

Repeatedly posting objectionable material is grounds for revocation of access to this website or any part of it.

11.   TERMINATION.  You agree that CAMH may, under certain circumstances and without prior notice, immediately terminate your postings, or other forms of submission to CAMH.

Cause for such termination shall include, but not be limited to, (a) breaches or violations of these terms or other incorporated agreements or guidelines or any publicly available CAMH policy, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) you have engaged in fraudulent or illegal activities.

Termination of your account includes (a) removal of access to all offerings within the website, including but not limited to postings, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring further use of the service.

Further, you agree that all terminations shall be made in CAMH's sole discretion and that CAMH shall not be liable to you or any third-party for any termination of your account, any associated email address, or access to the website or any service.
